Client struck a utility pole, snapped it in half and cut power to the whole area. His car rolled over and three cops had to bend the metal to get him out.  He failed the one leg stand test, the alphabet, the walk and turn and the backwards counting test. Then he told the cop he just had four beers, the last one an hour ago and had nothing to eat all day but breakfast.  Plus, he had slurred speech, bloodshot, glassy eyes and smelled of alcohol.

 I was still on Probation for OUI first offense in Salem when I was arrested for OUI-2nd in Ipswich. My Salem Probation Officer issued a Warrant for my arrest demanding I be taken into custody when I got to Newburyport.  The Newburyport DA was asking for jail also.  Joe incredibly managed to talk the judge out of having me taken into custody AND of sending me to jail for my 2nd offense.  Instead, the Judge released me into Joe's custody.

Then when we went to Salem later that day, my Probation officer was asking for a one year jail sentence on my first offense. Joe convinced the Salem Judge not to do so and I went home that night instead of to jail. Joe is the most intimidating and confident lawyer I have ever encountered and I was blessed to have him on my side.

After talking to Joe the first time, I knew I was in good hands. He is very professional, confident and knows all DUI laws like the back of his hand.  After the RMV suspended my license for 3 years for a breathalyzer refusal, he filed a civil suit against the RMV. He was very organized and aggressive in court. The judge gave my license back immediately after the hearing! That allowed me to drive legally during the months it took to go to Trial.  At Trial, he was completely prepared for the cross exam of all 3 officers and got me a not guilty. I was snow plowing and crashed my truck into the side of the house causing "extensive damage." I told them I only had three beers but they found an almost empty vodka bottle on the dashboard and my five year old son in front. I got extensive news coverage.  (They actually called me “Mr. Plowed” on the Internet!) Although two cops and the Chief of the Fire Department testified I was "disheveled" and gave their opinion I was OUI, Joe found an appellate case which had just come down the very week of trial. The judge said he had read it that morning, relied on it in issuing acquittals on all three charges and complimented Joe for finding it.

 The Cambridge officer wrote he saw me cross the center line three times, that my speech was slurred, my eyes glassy and bloodshot and that I told him I had two shots and two drinks. He worked tirelessly to keep the failed breath test out if evidence --which he successfully did. Then he got me acquitted. OK to call me.

I ended up on the rear lawn of a house after hitting a pole and going through a fence. They drew my blood at the hospital and it was over three times the legal limit. At a Motion to Suppress, Joe gets the blood test thrown out. At jury trial, his Motion to exclude all the medical records was allowed when he showed the DA hadn’t complied with the law. He just kept chipping away at their case until there was nothing left. I’m sorry I pestered him with so many questions instead of just letting him do his job.

I don’t know how he did it but at a preliminary Hearing he had my .21 breath test thrown out of Court. Then, at Trial, he brilliantly cross examined the cop forcing him to admit to everything I had done right. When I heard his closing argument reciting this long list, even I would have voted not guilty!

It was past 1 am on the night of a big snow storm. I couldn’t even see the lines the cop said I crossed over. Then I was so nervous that he didn’t like the way I said the alphabet or counted backwards and he arrested me. At Trial, two cops--not just one -- showed up to testify.  No matter. That didn't faze Joe. He was ready for them both.

During my 3 day Trial, a constable testified he followed me for 10 minutes, saw me drive all over the road and completely in the opposite lane for 20 seconds. 2 cops testified I failed 3 of 4 sobriety tests, was unsteady on my feet and had a “1000 yard stare.” Joe stressed that I stopped at every red light, proceeded when they turned green, was wearing heavy work boots and the cops’ flashing lights interfered with the testing. The jury agreed. Not Guilty. No jail. No 8 year license loss.

I faced possible jail and a license loss of 13 years. Joe noted in the report the cop had seen me wearing eyeglasses when he stopped me but told me to take them off before I did the balancing tests. Nowhere in his report did he tell me to put them back on.

Joe deliberately chose jurors who wore eyeglasses.

Joe asked the cop so many questions he had no idea how to answer. It was just really smart. He even impressed the Judge. They acquitted me in ten minutes and the Judge ordered my license restored immediately.

The cop saw me driving on the wrong side of the road, followed me into my driveway and arrested me. At the station, I foolishly took the breathalyzer and failed. My Court appointed lawyer did nothing for 16 months until my family hired Joe. With only two weeks to prepare for Trial, he fought vigorously every step of the way. He had pretrial Motions prepared and questioned the accuracy of the breath test. The DA just wouldn't quit, but after a hard fought Trial, Joe won a not guilty.

I was ready to take the First Offender Deal but after speaking with Joe I was convinced he could win my case.  He scheduled a Trial just 6 weeks after my arrest on a date he knew the judge on duty to be the most lenient.  When two police officers came instead of one, he quickly reacted with a Motion to Sequester so they couldn't speak and tell each other what they said in the Court room.  I was found Not Guilty and had my license reinstated the same afternoon.

Then he followed through and made sure I had all the documents and direction I needed to get my license back the same day.  I recommend him without hesitation. It is so nice to be able to drive again.

Joe brought a Motion to suppress the stop of my motorcycle proving the cop had followed me illegally into Somerville from Cambridge. He then brought another Motion to restore my license. The Judge agreed with both. Instead of 6 months in jail and 13 years without a license I am driving again.  I can’t thank him enough.

He paid attention to every minor detail and followed every possible lead.

It was my second offense. I failed both the field sobriety tests and had 21 cans of beer in the truck, one open in the console!. Joe did a painstaking cross examination of the cop, bringing it along slowly and stressing everything I had done right. We got a Not Guilty and the judge ordered my 3 year suspension for refusing the breath test overturned the same day.

My license was restored immediately!

My first arrest I blew a .32- four times the legal limit!. He arranged to have the case heard on the day before Christmas assuring me it was the best day of the year to get a good deal. He was absolutely right: I got just a slap on the wrist. Then when I got a second OUI out of state during the probation period for my first one, he told me exactly what I needed to do to avoid additional trouble in Massachusetts.

I was 17 and 18 when I got my first 2 OUIs. Arrested again at 35, under Melanie’s Law, I was charged with a 3rd offense, a felony, and faced a minimum 6 months in jail. Joe wrote a glowing letter to the DA’s office, detailing the reasons why the charges should be reduced. He knew which DA’s to negotiate with and which Judges would accept a reduction of the charges. On the very next Court date, that’s exactly what happened.
